7-Eleven instructed to pay Smithers woman over $900,000 due to life-altering pothole injury

The BC Supreme Court has awarded a Smithers woman $907,000 after breaking her ankle due to a pothole at a 7-Eleven Parking lot in 2018.

According to court documents, the incident occurred in May of 2018 when Crystal Tommy was on her way to work and decided to pickup a coffee.

As she left the convenience store, Tommy tripped on the pothole and broke her ankle in three places.

Since then, Tommy has suffered several complications and filed a claim of negligence for damages.

Tommy noted she missed several months of work at Woodmere Nursery while she was using crutches and a wheelchair.

Other side effects related to the fall include constant pain and stiffness in her left ankle, hips and lower back, which has also led to mental health and sleep difficulties.

Court documents stated she stopped working two years ago due to complications from the initial injury.

7-Eleven has denied liability for her injuries.

BC Supreme Court Judge Emily Burke agreed with Tommy granting the money for past and future loss of wages along with housekeeping and future cost of care.
